Terms and Conditions (T&C)

General Terms and Conditions (T&C) for the Services Provided by Yulia Majdak, Certified Nutritionist (ILS)
All written or verbal appointments constitute an agreement under these T&Cs.

§ 1 Scope

These T&Cs govern all business relationships between Yulia Majdak and the contracting party, whether an individual or a company – hereinafter referred to as the "Client."
These terms also apply to all future business relationships and do not require repeated explicit agreement.

§ 2 Service Agreement

§ 2.1 The agreement between Yulia Majdak and the Client is established upon acceptance of the request by Yulia Majdak. Acceptance can occur in writing, via email, or verbally.
§ 2.2 Services include the roles of nutritionist and chef. A cure or healing guarantee cannot and must not legally be promised.
§ 2.3 The Client will be advised on suitable therapeutic options for their condition and has the right to choose from the options offered by the consultant.
§ 2.4 Services are compensated with a fee and are not contingent on achieving a specific outcome. The costs for the consultation apply even if the treatment goal is not met.
§ 2.5 The success of the treatment heavily depends on the Client's cooperation. Therefore, Yulia Majdak cannot guarantee the achievement of specific treatment goals.
§ 2.6 Yulia Majdak adheres to confidentiality obligations and complies with the ethical code of the SVDE.

§ 3 Services

Yulia Majdak offers personalized nutrition counseling to improve clients' health and well-being. Counseling is based on information provided by the client and tailored to their individual needs and goals. Available services include:

• Free introductory consultations

• Individual consultations (initial and follow-up)

• Nutrition plan development

• Analysis of lab results

• Group cooking classes

• Private chef services

§ 4 Appointment Scheduling

All appointments scheduled via the website, text message, email, or verbally are considered binding unless canceled in a timely manner as per § 11.
§ 4.1 Rescheduling nutrition consultations must be communicated at least 24 hours in advance via the website, email, or verbally. The change is valid only after online confirmation or explicit acceptance by Yulia Majdak. Exceptions include force majeure, sudden illness (with a medical certificate), or accidents.
§ 4.2 Yulia Majdak reserves the right to modify or cancel services for organizational reasons and offer a replacement date. Any costs incurred by the Client (e.g., travel expenses, lost wages, childcare) remain the Client's responsibility.

§ 5 Booking

Upon booking any of the offered services, the Client will receive an email with the appointment confirmation, time details, and a link to the online consultation room. A reminder email is sent 24 hours before the appointment. The booking is binding, and cancellations are subject to § 11. In case of timely cancellation, costs will be refunded.

§ 6 Payment Terms

§ 6.1 Individual Consultations
Fees must be paid at the time of booking and before the consultation. If payment is not received by the scheduled date, Yulia Majdak reserves the right to cancel the service and charge the full consultation fee. Introductory consultations are free of charge.

§ 6.2 Membership in the Rasayana Club
Membership fees are invoiced and can be paid in installments upon request.

§ 6.3 Corporate Clients
Customized offers are provided after a needs assessment. A binding confirmation follows once the offer is approved.

§ 7 Materials

All written materials, including drawings and graphics, are copyrighted. Any use beyond the narrow limits of copyright law requires the author’s explicit consent. This includes reproductions, translations, microfilming, or electronic storage and processing.

§ 8 Communication Between Consultations

Clients may contact Yulia Majdak between consultations. Extended inquiries (> 15 minutes) are subject to additional fees and will be invoiced. Responses are generally provided within 24 hours on business days.

§ 9 Confidentiality and Data Protection

All client information and data are treated confidentially and in compliance with data protection regulations. Electronic communication may not guarantee the same level of confidentiality. Data is shared with third parties only with the Client’s explicit consent or when required by law. See the Privacy Policy for more details.

§ 10 Liability Disclaimer

Nutrition counseling is provided to the best of knowledge and belief. However, no liability is assumed for the accuracy, completeness, or timeliness of the information provided, or for any potential damages arising from the application of the advice.

§ 11 Cancellation Policy

Clients may cancel the following services free of charge within the specified timeframes. Cancellations outside these periods will incur full charges.

• Individual Nutrition Consultations (60 min): At least 24 hours in advance

• Group Cooking Classes: At least 3 weeks before the course

• Private Chef Services: At least 3 weeks before the event

Exceptions include force majeure, sudden illness (with a medical certificate), or accidents. Refund amounts in such cases will be negotiated individually.

§ 12 Final Provisions

These T&Cs are governed by Swiss law. If individual provisions of these T&Cs become invalid, the validity of the remaining provisions remains unaffected. Amendments or additions to these T&Cs must be made in writing.
